Rent control: high-demand areas, caps and rent supplement

In areas where housing demand far exceeds supply, setting the rent is not free. Two schemes coexist: control of rent changes in a zone tendue (high-demand area), and control of the level of rents in certain large cities. Setting too high a rent exposes you to action by the tenant.
High-demand area: what are we talking about?
Zones tendues (high-demand areas) are municipalities listed by decree where housing supply is structurally insufficient. They trigger specific rules: control of rent changes, a reduced tenant notice period (one month), and sometimes a tax on vacant homes.
Control of rent changes on reletting
In a high-demand area, when the tenant changes, the rent may not, as a rule, exceed the one applied to the previous tenant, revalued by the IRL. Exceptions exist (recent improvement works, a clearly under-valued rent).
Control of the level of rents
Some cities (Paris, Lille, Lyon, Bordeaux, Montpellier… depending on the orders in force) additionally apply control of the level of rents: the rent per square metre must stay within a band around a loyer de référence (reference rent) set by order, with a cap (the uplifted reference rent).
The rent supplement
Above the uplifted reference rent, the landlord may only add a complément de loyer (rent supplement) if the home has exceptional features of comfort or location, to be justified. An unjustified supplement can be challenged and refunded to the tenant.
